KANO STATE URBAN DEVELOPMENT BOARD EDICT 1976 (EDICT NO. 5 OF 1976)

KANO STATE URBAN DEVELOPMENT (BUILDING)

REGULATIONS 1987

In exercise of the powers conferred by Section 29 of the Kano State Urban Development Board Edict 1976 and all other powers enabling me in that behalf, I, GROUP CAPTAIN MOHAMMED NDATSU UMARU, Military Governor of Kano State of Nigeria I hereby make the following Regulations :——

PART I: PRELIMINARY

1. These Regulations may be cited as Kano State _Urban Planning and Development (Building) Regulations 1987.

Citation and Commencement

2. In these Regulations unless the context otherwise requires :— mm‘ ,

“Applicant” includes any person, corporation, association, institution who applies to the Board for building approval. “Architectural Drawing” means :1 drawing or plan prepared by at qualified Architect, or Draughtsman showing site plan, dimension and details of proposed building. “Authorized Officer” means an officer of the Board authorized and empowered by the Management or the Board to carry out any duty under these Regulations. “Board” means the Kano State Urban Development Board.

“Buffer Zone“ means an area or strip of land located and

planted usually with trees to provide a screen between residential

areal and commercial/Industrial area or between two distinct

land uses.

“Building” means any structure whether permanent or ” not

erected or made on, in, over or under any land and includes the

hind on, in, over or under which the building is erected.

“Commercial Building” includes the development of use of land

for the purpose of shop, office, overnight accommodation on

commercial basis, were house, catering facilities, night club,

wayside stall, cinema theater, sports stadium, market, clinic,

14 schools or any other development or use of land for commercial

activity or for other purposes incidential or reasonably connected therewith.

“Cul-de-sac” means =1 dead end street or road with only one “

end open to traffic.

“Development” means physical improvement of any land to be

laid out in the nature of building, drainage, structure of such improvement that may enhance the value of land for industrial, recreational, residential, commercial or agricultural purpose.

“Edict” means the Kano State Urban Development Board Edict No. 5 of 1976, together with any amendments made, thereto.

“Government” except where the context suggest otherwise, means Kano State Government.

“Habitable Space” means a space normally used for living, relaxing, studying or sleeping but does not include places of cooking, toilets or laundry.

“Industrial Building” means a development or use of land for

industrial or manufacturing purpose including making of any

article of description or substance; getting and treating of minerals; assembling, producing or repairing of vehicles, and other activities related or incidental to any of the above.

“Managing Director” means the Managing Director for the Board.

“Natural Lighting” means sunlight or daylight.

“Organically Developed” means existing, settlements with traditional order of growth.

“Open Space” means a vacant land earmarked as playground

or recreation or any other use.

“Public Building” means a building being carried, by or for the

Federal, State, Local Governments or by any of their known departments, agents, or institution but does not include a building of a government owned company.

“Residential Development” means a development for the purpose of providing shelter in of house, rooming, accommodation, estates, boarding houses or any other building or structure, permanent or not erected for a similar purpose.

“State” means Kano State of Nigeria.

“Stop Notice” means a notice, order issued by the Board, instructing a developer to stop further development.

Washing Place” means an ablution room or space and include bath/shower room, and wash-hand-basin

3. The Regulation shall apply to all areas designed as Urban Areas pursuant to the provisions of Land Use Act 1978.

PART ll: Application FOR BUILDING PLAN

4. (1) Every applicant for the approval of building plan within an urban area of kano state, submit to the managing director, Kano Urban Development Board, written application together with

(a) a copy of the certificate of occupancy or any other valid document of the land to be developed; and

(b) three~sets of architectural drawings, which shall include :—
